Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Perdura platform, including our website, applications, and related services (collectively, the "Service"), provided by DLG Holdings Limited ("Perdura," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Eligibility
The Service is intended for use by legal professionals and their authorized representatives. By using Perdura, you represent that you are at least 18 years of age, have the legal authority to enter into these Terms, and that your use complies with all applicable laws and professional regulations.
2. Account Registration
You must create an account to access the Service. You agree to provide accurate, current, and complete information during registration, and to keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at security@perdura.io if you suspect unauthorized access.
Accounts are associated with a firm. Firm administrators may invite additional users, manage permissions, and control access to evidence within their organization.
3. The Service
Perdura provides AI-powered digital evidence collection tools for intellectual property litigation. The Service enables you to:
- Capture and preserve web-based evidence with cryptographic timestamps
- Generate RFC 3161 compliant timestamps for evidentiary integrity
- Maintain chain-of-custody records suitable for court submission
- Export evidence as court-ready PDF bundles with embedded metadata
We do not provide legal advice. The Service is a tool to assist legal professionals in evidence collection, and its use does not constitute legal counsel or create an attorney-client relationship with Perdura.
4. Your Data
You retain all ownership rights in the evidence and data you collect through the Service ("Your Data"). By using the Service, you grant Perdura a limited license to process, store, and transmit Your Data solely for the purpose of providing the Service to you.
Perdura does not access, review, or analyze the content of Your Data, except as required to provide technical support at your request or to comply with legal obligations.
5. Acceptable Use
You agree not to:
- Use the Service to collect evidence in violation of applicable laws, including wiretapping, surveillance, or privacy statutes
- Attempt to circumvent, disable, or interfere with the platform's security features
- Use automated means to access the Service beyond the provided APIs
- Reverse-engineer, decompile, or disassemble any part of the Service
- Use the Service to harass, stalk, or intimidate any individual
- Sublicense, resell, or redistribute the Service without written authorization
6. Fees and Payment
Access to the Service requires a paid subscription. Fees are billed in advance on a monthly or annual basis, as selected during registration. All fees are non-refundable except as expressly stated in these Terms or required by law.
We reserve the right to modify our pricing with 30 days' advance notice. Price changes will not apply to the current billing period.
7. Evidentiary Disclaimers
While Perdura is designed to produce evidence suitable for court proceedings, we do not guarantee that evidence collected through the Service will be admitted in any particular jurisdiction or proceeding. Admissibility is subject to the rules of evidence and the discretion of the presiding court. You should consult with qualified legal counsel regarding the admissibility of digital evidence in your jurisdiction.
8. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated in advance. We are not liable for service interruptions caused by factors outside our reasonable control, including internet outages, third-party service failures, or force majeure events.
9. Intellectual Property
The Service, including its software, design, documentation, and branding, is owned by DLG Holdings Limited and protected by intellectual property laws. These Terms do not grant you any rights to use DLG Holdings Limited's trademarks, logos, or brand features without prior written consent.
10. Limitation of Liability
To the maximum extent permitted by law, Perdura's total liability arising out of or in connection with these Terms or the Service shall not exceed the fees paid by you in the twelve (12) months preceding the claim. Perdura shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
11. Indemnification
You agree to indemnify and hold harmless Perdura, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
12. Termination
Either party may terminate the account at any time. Upon termination, you will have 30 days to export Your Data before it is permanently deleted. Perdura may suspend or terminate your access immediately if you violate these Terms or if required by law.
Sections 4, 7, 10, 11, and 13 survive termination of these Terms.
13. Governing Law
These Terms are governed by the laws of Malta, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Malta.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the platform at least 30 days before taking effect. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
