EUIPO and USPTO require evidence of genuine use in the five-year period preceding the opposition filing date. Use outside this window does not satisfy the requirement.
ESTTA
USPTO filing system
All USPTO opposition evidence must be filed electronically via ESTTA in PDF format, maximum 10MB per file, within the prescribed evidence period.
eComm
EUIPO filing system
EUIPO evidence must be filed via the eComm online tool. All non-English evidence requires a certified translation filed at the same time.
Key Principle
Both EUIPO and USPTO operate strict, non-extendable evidence filing deadlines. Evidence not submitted within the prescribed period is excluded from the proceeding — regardless of its probative value.
