Amazon Brand Registry & Project Zero

A Checklist for Amazon IP Enforcement Evidence

Strong evidence produces faster removals and a stronger litigation record.

  • Capture the infringing ASIN completely — timestamp, seller, images, text
  • Document the infringement type precisely — TM, counterfeit, copyright, patent
  • Prepare evidence for Project Zero self-service removal — pre-removal capture
  • Retain originals for reinstatement challenges and resubmission
  • Escalate to notice and takedown for repeat infringers — account suspension
  • Build an evidence record for litigation — ASIN log, patterns, outcomes

ASIN
Primary enforcement identifier
Amazon's enforcement processes are built around the ASIN. Every enforcement action must reference the specific ASIN — not the product name or seller — for processing.
FBA
Fulfilled by Amazon flag
FBA status is relevant to both enforcement (Amazon is the direct fulfiller) and damages (Amazon's involvement may support wilfulness arguments in litigation).
4
Infringement types
Amazon Brand Registry requires precise categorisation: trademark, counterfeit, copyright, or patent. Incorrect categorisation results in rejection of the report.
Key Principle
Platform enforcement and litigation are not mutually exclusive. Every listing removed via Brand Registry or Project Zero must have a pre-takedown evidence capture — content disappears on removal and cannot be recovered.
